Cancellation and Refund Policy

Language learning is a long-term commitment. It’s also a marathon and not a sprint. If you need to cancel a lesson more than 24 hours before it starts, you may do so and apply the purchase price towards a future lesson. Within 24 hours or less, no refund is possible (because the teacher has set aside that time for your lesson and can’t use that time for another student on such short notice). Monetary refunds are not provided, so please be sure that you actually want to take a lesson before purchasing it.

FEES PAYABLE TO THE TEACHER

Fees are stated on the booking page. The 24-hour cancellation policy is stated above. Only credits towards future lessons are provided in case of a refund; no monetary restitution will be provided.

PAYMENT

Payment is handled on the website during the booking process through a third-party payment processor (Stripe). No credit card information is stored on our website.

SUPPLIERS

The teacher uses third-party providers for website hosting and lesson booking (WordPress) and payments (Stripe). Use of this website is subject to the additional terms and conditions of these third-party providers.

LATE ARRIVAL AND CHANGE OF SCHEDULE

Fees are based on the lesson length selected on the website. A student may cancel the lesson 24 hours or more prior to the lesson (subject to the cancellation policy above). If a student chooses to cancel the lesson later than 24 hours prior to the lesson start time, no credit for the lesson will be provided. No adjustment to lesson cost or time will be made due to late arrival by the student or by early termination of session by the student. The teacher agrees to wait for fifteen minutes from the time of the scheduled session for the student’s arrival before considering that session canceled without sufficient prior notice, and the lesson will be considered completed and paid at that point.

OBLIGATIONS OF THE TEACHER

The teacher undertakes to structure lessons in such a way as to optimize time to the benefit of the student.

OBLIGATIONS OF THE STUDENT

Students are required to conduct themselves appropriately and professionally during the lesson and during subsequent points of contact outside of the lesson. Inappropriate behavior can result in remedial outcomes at the teacher’s sole discretion, including, but not limited to, early termination of the lesson without monetary restitution, cancellation of subsequent lessons without monetary restitution, refusal to accept or honor subsequent lessons with the student, and reporting inappropriate behavior to legal authorities. The teacher, at her sole discretion, shall decide which behavior is appropriate or inappropriate. Inappropriate behavior includes, but is not limited to, not being fully-clothed during the lesson, making requests to not be fully clothed during the lesson, or any other behavior that is deemed, at the sole discretion of the teacher, to be threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, or invasive of another’s privacy.

The student undertakes to assist the teacher in identifying problem areas in which the student needs specific tutoring. The student agrees to provide their own materials needed for each teaching session. The student agrees that assignments, e-services, or homework form an integral part of teaching and undertakes to complete such work timeously.

NO WARRANTIES

The teacher makes no promises or warranties with regards to a student’s performance as a result of any tutoring provided.

STATUS OF THE TEACHER

It is expressly understood that the student retains the services of the teacher as an independent contractor and not as an employee.

RELAXATION OF TERMS

No relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement on one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

WHOLE AGREEMENT

This agreement constitutes the entire understanding between the parties with regard to the subject matter thereof and the parties waive the right to rely on any alleged expressed or implied provision not contained herein. Where the student is a legal minor, the parent/guardian shall enter into this teaching contract on behalf of the student and shall accept and agree to all the terms and conditions contained herein on behalf of the student.
